Iowans Want Supreme Court Justices Impeached

Iowa voters booted the three Iowa Supreme Court justices who appeared on the November ballot, and now Republican lawmakers are moving to impeach the remaining four justices. The seven justices unanimously imposed same-sex "marriage" in Iowa in 2009.

[State representative] Republicans Tom Shaw of Laurens, Glen Massie of Des Moines and Kim Pearson of Pleasant Hill are drafting articles of impeachment to try to remove the other four Supreme Court justices.

Shaw said in an interview on Friday that they are considering impeachment because they heard during the election campaign from voters angry about the court decision.

Under the Iowa Constitution, a justice can be impeached for any misdemeanor or malfeasance in office. Impeaching a justice requires a vote in the House, a trial in the Senate and then two-thirds of the state's senators would have to vote to impeach the justice.

The impeachment effort got a boost Wednesday when Speaker-elect Kraig Paulsen (R-Hiawatha) said if he thought Iowans wanted the four justices removed, he would not stand in the way. A few days earlier, state Sen. Kent Sorenson (R-Indianola), who will sit on the Senate Judiciary Committee, said he will also push for impeachment proceedings.

Paulsen spoke with the Cedar Rapids Gazette’s Todd Dorman about his statements, saying impeachment won’t be on the Iowa House’s agenda unless Iowans put it there.

“If Iowans get excited about it and start communicating that. It’s no different than any other question before us,” Paulsen said. “I don’t have reservations about doing what Iowans want us to do.”

Kim Pearson, R-Pleasant Hill, is one of the three Republicans drafting the bill. She wouldn't comment on how much support she thinks the bill will attract. She later sent a written statement saying that part of her duty as an elected official is to make sure that other branches of government function within their constitutional authority.

"In order to faithfully discharge our duties to support the Constitution of the United States and the Constitution of the State of Iowa, the remaining four Supreme Court justices should be impeached," Pearson wrote.
